Terms and Conditions
❖ MiracleRummy, an online platform operated by Gameskraft Technologies Private Limited (referred to as “Gameskraft”, “MiracleRummy”, “We”, “Us”, or “Our”), allows users (“You”/ “User”) to engage in online Rummy games with other participants. These Terms of Service for MiracleRummy (“Terms”), in conjunction with MiracleRummy’s Privacy Policy (“Privacy Policy”), Fair Play Policy (“Fair Play Policy”), and the collective Game Rules (defined below) (together referred to as “Platform Policies”), establish the relationship between You and Gameskraft. These Platform Policies constitute a legally binding agreement between You and Gameskraft, governing your access, use, and interaction with the MiracleRummy product, website, mobile apps, and associated services (“Services”).
❖ By utilizing the Services, You indicate acceptance of the Platform Policies, hence it is recommended to carefully review them before engaging with Our Services. If you do not agree with any aspect of the Platform Policies or any subsequent modifications, you must discontinue your use of Our Services.
❖ We retain the right to periodically assess, update, or modify any portion of the Platform Policies at our sole discretion, and it is advisable for You to stay informed about the most recent versions. Notification will be provided for any significant changes to the Platform Policies, and your continued use of the Services following such notice implies consent to the adjusted policies.
❖ In circumstances where any provision herein is deemed invalid or unlawful for any cause by a competent Indian judicial or quasi-judicial authority, the remaining terms will remain valid and binding on You and all other users, without being impacted by the nullification of the invalid term.
1. Interpretations:
1.1 “Relevant Legislation” refers to all applicable laws, regulations, statutes, treaties, conventions, ordinances, guidelines, rules, directives, notifications, judgments, decrees, injunctions, writs, orders, decisions of any court, awards, or official directives of any governmental entity in any jurisdiction that are relevant to the concerned individual.
1.2 “Financial Account” refers to a monetary account held with a Banking Institution or financial establishment and may also encompass a digital wallet maintained with an entity authorized by the Reserve Bank of India.
1.3 “Banking Institution” signifies a financial entity as defined under section 5(c) of the Banking Regulation Act, 1949.
1.4 “Restricted Territories” denote any Indian state where online gaming has been proscribed by the Relevant Legislation.
1.5 “Entry Fee” denotes the requisite amount to be wagered by a User to participate in a Cash Game on the Platform.
1.6 “Entry Fee Balance” represents the total sum available to a User to participate in Cash Games on the Platform.
1.7 “Cash-based Contests” signify contests that involve a financial investment, as agreed upon by the participants of said Contest, in compliance with the Game Regulations.
1.8 “Interactive Feature” signifies the in-game function that enables users to communicate with one another during gameplay.
1.9 “Deposit Segment” refers to the division of the RC Wallet where any funds deposited by a User with MiracleRummy for participation in Cash Games are credited, post deduction of applicable goods and services taxes ("GST") in accordance with the Relevant Legislation.
1.10 “Discounted Entry Fee” signifies the actual sum debited from the User's RC Wallet as an Entry Fee for a Cash Game, irrespective of the standard Entry Fee for that specific Cash Game.
1.11 “Promotional Credits” denote non-monetary credits that may be furnished by MiracleRummy, at its sole discretion, as part of a promotional initiative to enable Users to participate in Cash Games with Discounted Entry Fees. These credits cannot be withdrawn, have a set validity period as determined and notified to Users by MiracleRummy, and can only be utilized by a User for the designated purpose as determined by the Platform.
1.12 “Promotional Credit Segment” refers to the non-monetary section of the RC Wallet where the Promotional Credits balance is showcased for the User’s information. 1.13 “Contests” refer to the Rummy game variations available on MiracleRummy, encompassing different formats such as points, deals, pool, and tournaments.
1.14 “Gaming Segment Balance” denotes the division of the RC Wallet on the Platform that illustrates the amount accessible to the User for participating in Cash-based Contests.
1.15 “Game Regulations” for each Contest denote the specific rules and guidelines applicable to that Contest which can be accessed on the Platform.
1.16 “Platform” pertains to the MiracleRummy website and associated mobile/desktop applications where Contests are made accessible to users in diverse formats.
1.17 “Platform Guidelines” refer to the Terms of Service, Privacy Policy, and Fair Play Policy of MiracleRummy along with the collective Game Regulations for each Contest.
1.18 “MiracleRummy Account (RC Account)” embodies the User account maintained with MiracleRummy, granting Users access to participate in Contests.
1.19 “Reimbursement” signifies the reversal of amounts paid by a User to participate in a Cash Game (excluding GST) back to the User’s RC Account.
1.20 “Terms of Service” denote the terms and conditions of MiracleRummy.
1.21 “RC Wallet” symbolizes the section in the RC Account that enables Users to deposit and utilize funds on the Platform.
1.22 “Withdrawable Sum” signifies the amount in the Withdrawable Segment.
1.23 “Withdrawal” refers to the transfer of all or a portion of the Withdrawable Sum to a nominated Bank Account of a User, based on specific directives issued by the User to MiracleRummy to process such transaction.
1.24 “Withdrawal Application” signifies a User’s request on the Platform to initiate a Withdrawal.
2. Eligibility to Utilize Our Offerings:
2.1 Our Services are not designed for, or provided to, individuals under the age of 18 (eighteen) years, or individuals who reside in or access the Platform from any of the Restricted Territories. We hold the authority to monitor access to Our Services at all times within any region of India and retain the right to revise the list of Restricted Territories.
2.2 If You are below the age of 18 (eighteen) years or reside or are located in any of the Restricted Territories, You are not permitted to access or utilize Our Services. Should You proceed to do so, You will bear sole responsibility for any legal consequences arising from such use of Our Services. We retain the right to request evidence of age and location at any phase of Your interaction with Our Services to ensure that individuals below 18 years of age or those situated in the Restricted Territories do not access the Service. In instances where We suspect that an individual utilizing the Service is underage and fails to furnish valid proof of age or is located in a Restricted Territory, We reserve the right to prevent them from utilizing Our Services.
2.3 If You lack the legal capacity to independently engage in financial transactions in Indian Rupees via banking channels in India and/or are accessing the Services from a Restricted Territory, You are prohibited from engaging in Cash-based Games on Our Services. Any involvement in Cash Games under such circumstances will be considered a violation of the Platform Policies, rendering You ineligible to claim any prizes won in such Cash Games.
2.4 In the event that We identify or determine, at Our sole discretion, that Your usage of Our Services breaches the Platform Policies, We reserve the right to cease Your access and utilization of the Services.
3. Utilization of Our Services:
3.1 Gameskraft provides the opportunity to engage in online Rummy games via a mobile application, available for download and installation from our official website www.MiracleRummy.com, Google Play Store, the Apple App Store, and other applicable app stores.
3.2 Rummy is acknowledged as a game of skill, hence, it is considered legal to participate in Rummy games in the majority of states across India.
3.3 Our Platform is dedicated to maintaining fairness and transparency. The Random Number Generator (RNG) mechanism is utilized to operate the games featured within Our Services, with its implementation being certified by iTech Labs, a reputable global entity (ISO 17025 certified) responsible for RNG verification and certifications. Through the RNG process, random numbers are generated using an algorithm to ensure that all players receive cards selected at random from a thoroughly shuffled deck and are dealt with impartially by the system, devoid of any biases. These assessments were conducted in compliance with industry standards, utilizing substantial sample sizes, and iTech Labs has confirmed that the card sequences are unpredictable, non-repetitive, and evenly distributed.
3.4 Upon accessing Our Services and/or creating an RC Account, We may collect, utilize, share with third parties, store, or otherwise process Your information, which may encompass personal and sensitive personal data, to enable efficient utilization of the Services by You. The handling of such information is regulated by the Privacy Policy, an integral component of the Platform Policies. The Privacy Policy can be accessed here.
3.5 It is mandatory to verify Your mobile number during the registration process on the Platform. Rest assured, all Your information is maintained confidentially and handled in accordance with Our Privacy Policy.
3.6 Upon registering with Us, You consent to receive promotional and service updates from Us and our associates through SMS, email, calls, WhatsApp, and push notifications, concerning tournaments, promotions, and discounts of various kinds. Should you wish to revoke your consent to receive such communications, you can do so by emailing [email protected].
3.7 Issues related to internet connectivity on Your end, disruptions arising from your local internet environment, software or hardware setup errors on your device, or other external factors beyond Our jurisdiction, are considered beyond Our control. Consequently, You acknowledge and agree that We shall not be held liable for any interruptions, pauses, or disruptions in Your utilization of Our Services due to such issues.
3.8 Earnings (whether in monetary or non-monetary form) and Discount Credits (exclusively non-monetary) are specific to each player and cannot be transferred. Attempting to transfer any winnings or Discount Credits will be deemed a violation of these Terms, resulting in the forfeiture of such rewards or credits at Our discretion.
4. User Registration and RC Account Management:
4.1 To gain access to the Platform and its Services, you must establish an RC Account and complete the registration process by submitting a valid phone number or any other requisite information. It is imperative that you provide accurate, up-to-date, and complete details during the registration process and at all subsequent times as stipulated by MiracleRummy. Creating or utilizing multiple accounts on the Platform is strictly prohibited. If we identify multiple accounts associated with a single user, we reserve the right to take disciplinary actions, including the annulment of any balances related to Discount Credits across linked accounts and the suspension of said accounts.
4.2 Upon setting up an RC Account with Us, a default username is allocated to you. You have the option to modify or change your display name, which will serve as your identity ("Username") on the Platform. The selected Username is subject to compliance with these Terms and must not contain indecent, offensive, objectionable, or illegal content. Usernames that infringe on the intellectual property rights of any entity, disclose personal information, or suggest promotional or advertising activities may be disapproved. Your Username will remain active on the Platform unless We terminate or suspend your access to the Platform due to violations of the Platform Policies as outlined in these Terms, or if your RC Account becomes inactive in accordance with Clause 11.
5. Game Varieties and Regulations:
5.1 MiracleRummy offers the Rummy game in diverse formats and versions on the Platform, including Cash Games and non-cash Games. We retain the right to adjust the assortment of Game formats and variations available on the Platform at Our sole discretion. You are granted the choice to select a Game with any Buy-in/Discounted Buy-in corresponding to your skill level and understanding.
5.2 By engaging in Games on the Platform, you commit to complying with the relevant Game Rules. It is essential to ensure that you have reviewed and comprehended the applicable Game Rules before participating in any Game. The Game Rules are an integral part of the Platform Policies and can be accessed by selecting "See Rules" beneath the heading of the selected game type on the Platform.
5.3 We may introduce additional Games on the Platform periodically. The Platform Policies will govern all facets of these newly introduced Games, and the corresponding Game Rules for such new Game(s) will be provided to you.
5.4 The outcomes and champions of each Game are determined in accordance with the pertinent Game Rules. By registering and/or participating in any Game, you consent to these determinations, which are final and not subject to dispute. Lists of winners will be published on Our Platform following each Game.
5.5 If there is any contradiction between the information presented in the game rules/FAQ visible on the Platform and these Terms, these Terms will take precedence to the extent of any inconsistencies with the game rules/FAQs.
5.6 There is a possibility of winning prizes while participating in Games on the Platform. Such prizes are subject to specific terms and conditions communicated at the time of awarding the prize.
6. Limitations on the Utilization of Our Services:
6.1 It is prohibited to upload, distribute, transmit, publish, share, display, or post any content through Our Services or via any service or feature, including Communication Features, provided by Us that:
❖ - Pertains to another individual without proper authorization;
❖ - Contains defamatory, obscene, pornographic, invasive of privacy, harassing based on gender, libellous, racially or ethnically offensive, promotes money laundering or gambling, or is otherwise inconsistent with prevailing laws;
❖ - Poses harm to a minor;
❖ - Infringes upon patents, trademarks, copyrights, or other intellectual property rights;
❖ - Misleads the recipient regarding the message's origin or delivers knowingly false or deceptive information that may be perceived as factual;
❖ - Assumes another person's identity;
❖ - Endangers the unity, integrity, security, or sovereignty of India, disrupts friendly relations with foreign nations, instigates criminal behavior, obstructs investigation of offenses, or denigrates other countries;
❖ - Contains malicious software or any code intended to disrupt computer resources;
❖ - Spreads false and misleading information with the intention to deceive or harm individuals, entities, or agencies for financial gain or personal injury;
❖ - Presents objectionable or unwanted material, whether or not unlawful;
❖ - Seeks donations, chips, or any other form of assistance;
❖ - Degrades Gameskraft, its subsidiaries, affiliates, licensors, associates, partners, sponsors, products, services, or websites in any manner;
❖ - Promotes a rival product or service;
❖ - Contravenes any relevant laws and regulations.
6.2 The Communication Feature for a user may be promptly suspended without prior notice if We determine that the user is engaging in activities prohibited under Clause 6.1 above or elsewhere in the Platform Policies. Such behavior may result in the suspension of the user's RC Account. Should you encounter any abusive or malicious conduct by another user, you have the option to report it to us by following the complaint procedure outlined in Clause 16 below.
6.3 It is strictly forbidden to host, intercept, replicate, or divert proprietary communication protocols utilized by Us, if applicable, through various means such as protocol replication, reverse engineering, or modification of Our Services or any related files.
6.4 You are not allowed to frame Our Services, overlay editorial comments, commercial content, or any data onto Our Services, amend or alter any content, or remove, conceal, or interfere with any proprietary notices or tags.
6.5 Our Services are not to be utilized for commercial objectives, including but not limited to use in a cyber cafe as a gaming center, network play over the Internet, or via unauthorized servers attempting to replicate the gaming experience provided by Us.
6.6 Trading, selling, renting, leasing, licensing, securing an interest in, or transferring Your RC Account, content, funds, culture club points, standings, rankings, ratings, or any other associated attributes derived from or linked to Our Services is prohibited.
6.7 Any fraudulent activities, such as attempting to use someone else's credit or debit card information, net-banking details, authorization codes, prepaid cards, or mobile devices to add funds to the Deposit Segment, accessing the Services through another user's RC Account, are strictly forbidden. If We suspect or become aware of such fraudulent behavior, We reserve the right to terminate Your RC Account and notify relevant authorities as deemed necessary at Our sole discretion.
6.8 Individuals who hold positions as officers, directors, employees, consultants, or agents of Gameskraft, or are related to such individuals, are not permitted to participate in Cash Games that offer prizes while associated with Gameskraft, either directly or indirectly. The term 'relative' is defined in accordance with Section 2(77) of the Companies Act, 2013, for the purposes outlined in these Terms.
6.9 You are responsible for safeguarding Your RC Account and ensuring that no external parties access or utilize it. Additionally, You must not seek external aid to engage in gameplay or activities that contravene the Platform Policies.
6.10 The usage of Our Services for illicit or prohibited purposes, including attempts to launder funds in Your RC Wallet or intentionally losing money to specific players, is strictly prohibited.
6.11 Sending spam emails or any form of unsolicited communication to other Platform users for any reason is not permitted.
7. Deposit, Payment, Withdrawal, Refund, and Termination:
7.1 Deposit
❖ All transactions conducted on the Platform necessitate the use of your RC Wallet, following the outlined procedures. Any funds that you deposit with MiracleRummy are allocated to the Deposit Balance Segment (excluding GST), the funds available for use in Cash Games are displayed in the Game Balance Segment, and any winnings you earn are automatically placed in the Withdrawable Segment, unless you opt to transfer a portion of your winnings to the Game Balance Segment, based on ongoing promotional deals (if applicable) on the Platform. Your RC Wallet maintains a detailed record of all your transactions on the Platform.
❖ Any funds received from you are securely held by Gameskraft in a designated account. By participating in Cash Games, you grant Gameskraft authorization to appoint a third party, Trustee, or Escrow Agent to oversee the management of your deposited funds. The funds collected from you are stored in a separate, non-interest-bearing bank account, as per these Terms. These bank accounts are operated by a third party designated by Gameskraft. Payouts from these accounts can be disbursed to (a) users (for their withdrawals), (b) Gameskraft (toward its margin), and (c) government authorities (including GST, TDS on winnings), among others.
❖ All transactions with Us are to be conducted in Indian Rupees (INR), and we do not accept deposits in any other currency or in the form of virtual digital assets. You are permitted to deposit funds into the Deposit Balance Segment for participation in Cash Games, subject to the following stipulations:
- You may only deposit up to INR 50,000 (Indian Rupees Fifty Thousand only) in a single transaction into the
Deposit
Balance Segment.
- Monthly deposit limits set by Us, along with specified undertakings, indemnities, waivers, and verification
conditions
as determined at Our discretion. Any modifications to the deposit limits will be communicated to you through
the
Platform.
- GST will be levied on the amounts deposited into the Deposit Balance Segment at the rates prescribed by the
Government.
❖ The deposits you make in the Deposit Balance Segment are solely intended to facilitate your participation in Cash Games and do not accrue any interest or returns. You have the option to transfer the funds from the Deposit Balance Segment to the Game Balance Segment for use in Cash Games.
❖ Gameskraft will provide you with a GST-compliant invoice, available for download in the RC Wallet section of the Platform, reflecting the deemed supply of specified actionable claims by Gameskraft to you when depositing funds into the Deposit Balance Segment.
❖ Transfers between your RC Wallet and another user's RC Wallet are prohibited, except where specifically authorized by MiracleRummy.
❖ By adding funds to your RC Wallet, you confirm that the payment method used belongs to you.
❖ Payments made via credit cards, debit cards, prepaid cash cards, and Internet banking are processed through third-party gateways. Authorization by the payment processor is also required for other payment methods. Any delays or denials in payment processing are beyond our control. Payment processing is subject to the policies and procedures of the relevant third parties.
❖ In the event of any issues with depositing funds on the Platform, you can report the problem to us following the complaint procedure outlined in Clause 16 below.
❖ We are not liable for delays or denials in credit approval, and it is your responsibility to address any payment instrument provider issues. Once a payment is authorized and funds are received by us, the deposited amount (excluding GST) is credited to the Deposit Balance Segment, ready to be transferred to the Game Balance Segment for Cash Game participation.
❖ We retain the right to cancel a transaction at our discretion, and if the payment has already been processed successfully, the transaction will be reversed, and the funds (excluding GST) will be credited back to the original payment source.
7.2 Withdrawal
❖ You have the option to transfer all or a portion of your Withdrawable Balance to your Bank Account through an electronic bank-to-bank transfer or another method based on your preferences and compliance with Applicable Laws.
❖ Additionally, you can choose to move a part of your Withdrawable Balance to the Game Balance Segment and receive Discount Credits according to ongoing promotional offers (like Superboost or other offers determined by MiracleRummy) on the Platform. The percentage of your Withdrawable Balance that can be transferred to the Game Balance Segment is solely determined by Gameskraft and will be presented to you in the information panel as an offer to avail of this option.
7.3 When initiating a Withdrawal Request, you must provide Us with the details of your Bank Account for the funds to be deposited, and the Bank Account must be in your name.
7.4 Your Withdrawal Request will be processed after satisfactory KYC verifications, alignment with the deposit method, and security checks by our automated systems and risk management team. All your Withdrawals are subject to the following conditions:
- You can make a Withdrawal Request once every 24 hours.
- You have the flexibility to Withdraw all or part of your Withdrawable Balance. A processing fee, a
withholding and
withdrawal charge (determined by us based on factors like your activity on the Platform), and GST (if
applicable) will
be levied. The Withdrawal Charge amount will be communicated to you at the time of placing the request, and we
will
issue a GST-compliant invoice available for download in the RC Wallet section.
- The minimum Withdrawal amount is INR 100.00 (Indian Rupees One Hundred only), and the maximum is INR
1,00,000.00
(Indian Rupees One Lakh only) per transaction. Payments will be made through electronic wire transfer or as
per your
specified preferences and regulations. We may also credit the amount to the financial instrument used for
depositing
funds in your Deposit Balance Segment. These withdrawal limits are subject to change by us.
- Withdrawal Requests are processed post completion of KYC verification, subject to terms and restrictions
listed in
these Terms and on the Platform. KYC documents may be requested at any time for verification of identity and
address.
- Discount Credits are non-monetary and non-withdrawable, subject to specific terms and conditions.
7.5 While we strive to process your Withdrawal Request promptly, delays may occur due to KYC verification, security checks, and other procedures. We are not liable to compensate for any delays in processing Withdrawal Requests and payments.
7.6 Refund
❖ If you have unused funds in your Deposit Balance Segment and wish to request a Refund, you can do so by reaching out to Support, completing KYC requirements, and abiding by the following guidelines:
- Upon receiving your Refund request, we will process it within 2 (two) weeks and credit the Refund amount to the original payment source within that timeframe.
- You must submit a Refund request within 180 (one hundred and eighty) days of adding the funds to your Deposit Balance Segment.
- Any GST deducted at the time of fund deposit is non-refundable as per Applicable Laws.
7.7 The refund policy for cancelled Cash Games will align with the terms and conditions set forth on the Platform at the commencement of the respective Cash Game.
7.8 Your winnings may be reported to relevant authorities, and necessary amounts may be withheld from payouts to comply with Applicable Laws and legal requests from government entities, regulatory bodies, tax authorities, or court orders. It is your responsibility to ensure appropriate payment of all applicable taxes.
8. KYC Verification:
8.1 Users are required to undergo an additional online document verification process known as KYC in the following situations:
❖ When requesting a Withdrawal;
❖ If there are suspicions or notifications of violations of Platform Policies;
❖ If you exceed the specified add cash thresholds;
❖ If you receive a promotional offer from the Platform or have winnings credited to your RC Wallet;
❖ As mandated by Applicable Laws;
❖ As determined by Gameskraft at its discretion periodically.
8.2 As part of the KYC process, users are prompted to upload documents and information related to their PAN (Permanent Account Number) and Bank Account details through our automated system.
8.3 KYC documents and information must be uploaded directly on our Platform, and we do not accept submissions through any other means.
8.4 When uploading documents on our Platform, ensure that:
❖ The documents are valid;
❖ The document is clear and legible, provided in jpg, jpeg, or pdf format;
❖ The documents are not password-protected.
8.5 Validation of KYC documents may take up to 3 (three) working days from the date of submission. We hold the right to validate or reject KYC documents at our discretion. You will receive notification of the KYC verification status on your registered mobile number/email address and on the Platform.
9. Discount Credits:
9.1 Whenever you add funds to the Deposit Segment, request a Withdrawal, engage in promotional offers on the Platform, or complete specific actions determined by us at Gameskraft, you may receive Discount Credits at our discretion. These Discount Credits are displayed in the Discount Credit Segment and are subject to conditions related to your activity on the Platform or participation in Cash Games, as determined by Gameskraft. It's important to note that Discount Credits have an expiration date, which may vary depending on the ongoing promotions.
9.2 Please be aware that all Discount Credits provided by Gameskraft are intended for facilitating discounted Buy-ins for Cash Games, and MiracleRummy reserves the right to adjust and modify the Discount Credits as needed. Additionally, specific conditions may apply to the use of Discount Credits, such as being limited to certain game types or available for use after a specified time period.
9.3 Prior to starting a Cash Game, you will have access to details regarding each transaction, including the applicable Discount Credits, through an information panel provided to you.
9.4 If your RC Account is terminated voluntarily by you or by us in accordance with the Terms, any allocated Discount Credits will be cancelled, and you will no longer have rights to those Discount Credits.
9.5 Any breach of Platform Policies could lead to disqualification from receiving Discount Credits or other promotional winnings.
9.6 Discount Credits cannot be exchanged for cash or other rewards, nor can they be withdrawn directly or transferred to another user.
9.7 MiracleRummy may, at its discretion, offer Games where you can utilize your Discount Credits to participate. Any winnings from these Games will also be in the form of Discount Credits displayed in the Discount Credits Segment.
10. Taxes:
10.1 As per the applicable laws, Tax Deducted at Source (TDS) will be deducted on the Net Winnings, which is calculated as the difference between Total Withdrawals and Total Deposits within a financial year (running from 1st April to 31st March). TDS will be deducted at a rate of thirty (30) percent on the Net Winnings during Withdrawal and at the end of the financial year on the remaining Net Winnings balance. Please note that the TDS policy, limits, and rates are subject to change in accordance with the law, and Gameskraft reserves the right to adjust them accordingly. Our responsibility is limited to deducting TDS as mandated by the law and issuing you with the necessary tax deduction certificate. We also retain the right to verify your PAN periodically and cancel any prize if inconsistencies are found during our KYC verification process.
10.2 It is essential that your PAN is linked with your Aadhaar, valid, and compliant with the Income Tax laws. Gameskraft will not be liable to provide TDS certificates or credits to users whose PAN has been rendered inactive as per the directives issued by the Income Tax authorities.
10.3 We hold no liability or involvement in managing your personal tax-related affairs.
11. Termination, Suspension, and Opt-out:
11.1 Failure to log in to your RC Account at least once within a 12-month period will result in your account being deemed inactive, and a maintenance fee of INR 250 per year may be debited at our discretion from any remaining funds ("Inactive Account Fee").
11.2 We retain the right to suspend or terminate your RC Account if violations of our Platform Policies are detected or if any security breaches or attempts are made towards our Services. In such cases, your account may be terminated immediately, and any prizes, promotional winnings, or funds within may be forfeited.
11.3 If your RC Account is terminated by us as outlined in Clause 11.2, the following actions will be taken:
❖ You will no longer be able to access our Services using the mobile number, PAN, and Bank Account associated with the terminated RC Account;
❖ You will be allowed to Withdraw any remaining Withdrawable Balance, subject to the restrictions specified in the Platform Policies.
11.4 Additionally, if we discover a user attempting to breach our security or privacy protocols, we may conduct an internal inquiry and implement various corrective measures based on the severity of the breach, including:
❖ Permanently suspending the user's access to our Services;
❖ Terminating the user's RC Account indefinitely;
❖ Restricting Withdrawals for the user;
❖ Seeking compensation for any loss incurred by our Services due to the breach and potentially pursuing legal action against the user for violating laws and Platform Policies;
❖ Prohibiting the user from future registration with us.
11.5 In cases where there is suspicion of Fair Play Violation:
-Notification of the breach or attempted breach will be sent to the user;
-We reserve the right to investigate and monitor the user's RC Account and gameplay for up to 180 days from
the breach
notification date. During this period, the funds of both users involved in Fair Play Violations will be
frozen. The
investigation will encompass all games played by the concerned user since registration on the Platform.
-Upon completion of the investigation, if a Fair Play Violation is confirmed in your RC Account:
❖ Funds in your RC Wallet linked to the violation may be forfeited;
❖ Compensation may be provided to affected parties or returned funds related to the violation;
❖ A Fair Play violation fee of up to INR 10,000 per violation instance may be charged. This fee covers costs incurred by the Platform due to the violation. If there are insufficient funds in your RC Wallet, the fee may be claimed from you in accordance with the law.
Fair Play Violation refers to any user activity that contravenes Platform Policies, including:
❖ Manipulating game outcomes through unfair means, regardless of the beneficiary;
❖ Engaging in fraudulent, illegal, or unjust practices determined by Gameskraft;
❖ Facilitating unauthorized fund transfers between individuals or sources;
❖ Colluding with other players to influence game results (syndicate playing);
❖ Any other activities deemed as violations by MiracleRummy periodically.
11.6 If we are alerted or informed by a governmental, police, or law enforcement agency regarding cyber fraud or any fraudulent activities associated with your RC Account, we retain the right to (a) suspend your RC Account; and (b) transfer any funds held in your RC Wallet to the designated Bank Account as instructed by the respective authority. Additionally, we reserve the right to halt all Withdrawals from your RC Wallet as per directions from the government, police, or law enforcement agency.
11.7 We may conduct verification of your RC Account via phone call or email. Should we be unable to reach you initially, we will make multiple attempts to establish contact. If the provided phone number or email address is incorrect, we cannot be held responsible for any disruptions to your Service access. If contact remains unsuccessful or validation fails, we reserve the right to restrict your access to Services until successful validation is achieved. You will be notified by email regarding the necessary steps for RC Account validation. Periodically, we may request identification and address verification. If access is limited due to unsuccessful validation, it may take up to seven (7) working days to reinstate full access upon successful validation. After repeated unsuccessful contact attempts, we reserve the right to terminate your RC Wallet and refund any Deposit Balance. We are not liable for any claims, damages, or losses resulting from such termination or restrictions.
11.8 You have the option to discontinue using our Services by sending an email expressing your intent to [email protected] ("Discontinuation Request"). If a positive Withdrawable Balance or funds in your Deposit Segment are present at the time of discontinuation, we will electronically transfer the funds to you in accordance with our Terms, subject to applicable charges. This may include an account closure fee of INR 1,000.00 or ten (10) percent of the total transfer amount, whichever is higher. If such a fee is applicable, a GST-compliant invoice will be issued for your reference, accessible for download from the RC Wallet section on the Platform.
12. Your Statements and Promises:
12.1 You affirm that:
❖ You have the necessary qualifications and competency to engage in transactions with other users and Gameskraft.
❖ All information you provide to us during the use of our Services, whether during registration or afterwards, is accurate, complete, current, and precise. We are not liable for any claims regarding the accuracy, completeness, and correctness of the information provided. We reserve the right, at our discretion, to request verification of the information's accuracy and may ask for additional documentation. Failure to provide valid proof may result in limitations on your Service access.
❖ You will safeguard the information you provide and refrain from sharing your RC Account login details with others, including fellow MiracleRummy users and Gameskraft representatives. You acknowledge that we bear no responsibility for any unauthorized usage of your RC Account due to information sharing.
❖ You possess the necessary legal rights to any content you share on the Platform, ensuring it does not violate third-party intellectual property rights.
❖ Your RC Wallet usage is limited to playing games through our Services and cannot be used for money laundering or illegal activities.
❖ Prior to engaging in Cash Games, confirm the legality of such activities in your jurisdiction.
❖ You possess the requisite skills and experience to participate in Platform games and do not suffer from any conditions hindering your ability to fully participate.
❖ Understand that playing Cash Games carries financial risks, and by participating, you assume full responsibility for potential losses. Gameskraft is not liable for any financial losses incurred during Platform use.
❖ You acknowledge that participation in a Game does not guarantee a prize, as winnings depend on game outcomes, player skills, and Platform Policies.
❖ Gameskraft is not accountable for any access difficulties or eligibility issues during your participation in Games. This includes login delays, pending validations, or policy violations.
